These terms govern your use of the public Kotta website and the forms on it. Please read them before using the site.

1. Who operates this site

This website is operated by Longrad Ltd, a company incorporated and registered in England and Wales under company number 08560970, whose registered office is at 23 Berkeley Square, Mayfair, London, W1J 6HE, United Kingdom. In these terms, “we”, “us” and “our” mean Longrad Ltd. Kotta is a product of Longrad Ltd.

If Kotta later becomes a separate legal entity, these terms and the operator named in them will be updated accordingly.

2. What these terms cover

These terms apply to:

  • your use of the public Kotta website at https://mykotta.com;
  • the contact form; and
  • the request-access form.

They do not govern use of the Kotta application itself. Where separate customer or subscription terms apply to an account, those terms govern that account and nothing here replaces, varies or duplicates them.

By using this website you accept these terms. If you do not accept them, please do not use the site.

3. About Kotta

Kotta is software for organising and presenting property selections and the material that goes with them. It is a tool used by property professionals to present information to their own clients.

Kotta is not an estate agency, a property portal, a listing marketplace or a party to any property transaction. We do not verify and do not guarantee any of the following in respect of any property presented using Kotta:

  • availability;
  • price or any figure quoted;
  • dimensions, areas or distances;
  • tenure or title;
  • planning status or permitted use;
  • tax position;
  • legal status; or
  • the accuracy or completeness of third-party particulars, brochures or descriptions.

4. Acceptable use

You must not:

  • use this site for any unlawful purpose, or in any unlawful way;
  • attempt to gain unauthorised access to the site, the servers it runs on, or any connected system or account;
  • introduce any virus, worm, logic bomb or other material that is malicious or technologically harmful;
  • misuse the forms on this site, including by submitting false information, submitting other people’s details without their authority, or sending automated or repeated submissions;
  • infringe anyone’s intellectual property, privacy or other rights;
  • scrape, crawl or harvest content from the site by automated means except as permitted by our robots.txt file;
  • impersonate any person or organisation, or misrepresent your connection with one; or
  • attack the site by way of denial-of-service or otherwise interfere with its normal operation.

We may suspend or withdraw access to the site, in whole or in part, if you breach this clause.

5. Material you upload or share

Where you upload or share material through Kotta — including brochures, particulars, photographs, floorplans and related documents — you confirm that you have the right to do so and the authority of anyone whose rights are affected.

You keep ownership of your material. You grant us only the rights we need to provide the service: to host, store, copy, adapt in format, and display that material for the purpose of presenting it to you and to the people you choose to share it with, and to keep backups. That permission lasts as long as we hold the material in order to provide the service, and it is not a licence to use your material for our own marketing.

We may remove material that we reasonably believe breaches these terms or infringes someone’s rights.

6. Intellectual property

The Kotta brand and name, the software, the interface, the design of this site and its original copy are owned by or licensed to us, and are protected by intellectual property law. You may view and print pages of this site for your own use. You may not otherwise copy, adapt or republish any part of it without our permission.

Property names, agency names and third-party trade marks referred to anywhere on this site remain the property of their respective owners.

7. Property information and advice

All property information should be independently verified before you enter into any transaction. Nothing on this website constitutes legal advice, tax advice, valuation advice, financial advice or investment advice, and it should not be relied on as any of those. You should take your own professional advice.

8. Availability

We do not guarantee that this website will always be available or uninterrupted, or that it will be free of errors. We may suspend, withdraw or change all or any part of the site without notice. We are not liable to you if the site is unavailable at any time or for any period.

9. Third-party content and links

This site may contain links to third-party websites and may display content supplied by third parties. Those links and that content are provided for information only and do not imply that we approve of them. We have no control over the content of third-party sites and accept no responsibility for them or for any loss arising from your use of them.

10. Our liability to you

Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited or excluded.

Subject to that, and where you use this site as a business or in the course of your profession, we exclude all implied conditions, warranties and representations to the fullest extent permitted by law, and we are not liable for:

  • loss of profits, sales, business or revenue;
  • loss of anticipated savings;
  • loss of business opportunity, goodwill or reputation; or
  • any indirect or consequential loss.

Where you use this site as a consumer, we are responsible for loss or damage you suffer that is a foreseeable result of our breaking these terms or failing to use reasonable care and skill, and nothing here affects your statutory rights.

11. Privacy and cookies

How we handle personal information is set out in our Privacy Policy, and how this site uses cookies is set out in our Cookie Policy. Both form part of your use of this site.

12. Changes to these terms

We may update these terms. The version published on this page is the one that applies, and the “last updated” date at the top of this page shows when it last changed. Please check it from time to time.

13. Governing law

These terms and any dispute arising out of them are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction. If you are a consumer resident elsewhere in the United Kingdom, you may also bring proceedings in the courts of the part of the United Kingdom in which you live, and you keep the benefit of any mandatory protections of the law there.
